First-Time DUI Charges
Any driver cited for their first DUI is subject to a Class W misdemeanor charge. While this carries possible jail time of up to 60 days, Attorney Tom Olsen can pursue probation as an alternative, including a mandatory alcohol education program. A conviction will earn a six-month driver's license revocation and a fine of up to $500.
For drivers whose blood-alcohol concentration registers at .15 or above, this is considered aggravated DUI, which comes with harsher penalties including license suspension for up to a year.
Ignition Interlock Permits
First-time DUI offenders can apply for and receive an ignition interlock permit in order to maintain their full driving privileges with the installation of an in-vehicle breathalyzer. The driver must pass a breath test prior to starting the vehicle and at various points during operation. This option is available if an individual waives their right to a DMV Administrative License Revocation (ALR) hearing. It is open to those charged with regular (.08 BAC to .14) and aggravated DUI.
